These Terms are governed by the laws of the Republic of South Africa, including but not limited to the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and the Protection of Personal Information Act 4 of 2013 (POPIA).

3. OUR PRODUCTS

We have made every effort to accurately represent our products and services. However, please note:

  • Colours or product appearance may differ from how they appear on your screen due to your device settings and configuration.
  • We do not warrant that product quality or appearance will meet your expectations or match depictions on our website.
  • All product descriptions are subject to change at any time at our sole discretion.
  • We reserve the right to discontinue any product and to limit quantities offered to any person, geographic region, or jurisdiction.

4. ORDERS

When you place an order, you are making an offer to purchase. Almega Traders (Pty) Ltd reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm acceptance and receive your payment.

Please review your order carefully before submitting. After an order is accepted, Almega Traders may be unable to accommodate cancellation requests. In the event we do not accept, change, or cancel an order, we will notify you at the contact details provided at the time of the order.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.

5. PRICES AND BILLING

Prices are displayed in South African Rand (ZAR). All prices are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation email.

Unless otherwise stated, prices do not include shipping or handling charges, which will be calculated and displayed at checkout. Almega Traders is not VAT registered; therefore, no VAT will be charged.

You represent and warrant that the payment information you provide is accurate, current, and complete, and that you are authorised to use the payment method provided.

6. SHIPPING AND DELIVERY

Almega Traders ships within South Africa only. Delivery times are estimates only and are not guaranteed. We are not liable for shipping and delivery delays caused by courier services, customs processing, or events outside our control.

Once products are transferred to the carrier, title and risk of loss pass to you. It is your responsibility to ensure that someone is available to receive the delivery at the provided address.

7. CONSUMER RIGHTS UNDER THE CPA

As a consumer, you are entitled to the rights afforded to you by the Consumer Protection Act 68 of 2008, including but not limited to:

  • The right to fair and honest dealing.
  • The right to disclosure and information.
  • The right to fair, just, and reasonable terms and conditions.
  • The right to cancel a fixed-term agreement with 20 business days' notice.
  • The right to return unsafe or defective goods.

Nothing in these Terms limits or waives any rights you have under the CPA or any other applicable South African legislation.

All content on our website, including but not limited to trademarks, text, images, graphics, video, audio, and design, is owned by or licensed to Almega Traders (Pty) Ltd and is protected by applicable intellectual property laws.

Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid for the specific order giving rise to the claim.

Nothing in these Terms excludes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded by law.

11. PROHIBITED USES

You may access and use our services for lawful purposes only. You may not:

  • Use our services for any unlawful or malicious purpose.
  • Violate any applicable laws, regulations, or ordinances.
  • Infringe our intellectual property rights or those of any third party.
  • Transmit viruses, malware, or other malicious code.
  • Use automated tools, bots, or scripts to access or scrape our website without consent.
  • Impersonate any person or entity.
